The Happy at Home Co Shopping Agreement
When shopping online, you the customer, enter into a binding agreement with Happy at Home Co, trading as Happy at Home Co under The Happy Apple PTY LTD (ABN 12 166 233 263) and agree to the Terms and Conditions outlined below. By completing your registration online or placing an order, you are bound by these Terms and Conditions and agree to comply fully. The Happy at Home Co reserves the right to amend or update such terms, conditions, disclaimers and limitations of liability at any time without providing notice to you. Purchases of alcohol products made through http://www.happyathomeco.com.au are made under The Happy Apple Greengrocer: VIC Licence No. 32050564. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. If you purchase products via Happy at Home Co online store, you warrant to us that:
- You are over the age of 18 years
- And, any person that you are obtaining the products for, or supply the products to, is over the age of 18 years.
1. General
i. You, the customer, may place orders through the online site happyathomeco.com.au in accordance with the Terms and Conditions.
ii. When placing an order, you, the customer, enter into a contract with the store for the purchase of said goods at the advertised price listed on the site (happyathomeco.com.au), including any and all additional charges including but not limited to Service Fees, Delivery Fees or any other fees outlined by the Site.
iii. We may require additional details from you, the customer, to complete your order. If this is required the store will contact you directly.
iv. You agree that the information you provide is accurate, current and not misleading in any way.
v. We reserve the right to reject your order for any reason. If we do reject an order placed through the Site, we will do our best to contact you at a reasonable time to discuss the matter.
vi. If you are under 18 years of age, then you must obtain your parent or guardian’s consent before using the Site, its features or placing an order.
vii. As well as complying with these Terms and Conditions, in regards to the sale of tobacco and liquor items, or any other restricted items, you must also fully comply with all relevant State and Federal legislation.
viii. The minimum purchase price for an order to be delivered is $35. This excludes any service fees, delivery fees or additional charges.
2. Delivery of Goods
i. Happy at Home Co will only deliver goods ordered through the Site to an address within our delivery range. Please contact the store directly to confirm delivery to your address if outside of this area.
ii. Upon delivery and receipt of goods, you take full ownership and responsibility for the condition of the goods delivered.
iii. We reserve the right to refuse to deliver liquor for any reason. This reservation includes, but is not limited to, refusing service to individuals who are visibly intoxicated, and refusing service to specific buildings for access or safety reasons.
iv. If goods are unable to be delivered due to the above reasons and goods have to be re-delivered, a fee of up to $20 may be incurred.
v. All deliveries of liquor MUST be signed for by an individual capable of proving he or she is 18 years of age or older. The order signee must provide a valid form of photo identification at the time of delivery. Liquor cannot be dropped off or left unattended for any reason. If no one at the delivery address is at least 18 years of age and/or
cannot provide valid photo identification of his or her age to the satisfaction of the delivery person, the liquor will be cleared from the order and returned to Happy at Home co.
vi. Acceptable forms of photo identification include: a valid driver’s licence issued by an Australian State or Territory, a valid Australian passport, or a valid passport from any other country, a document issued by the Commonwealth, or a State or Territory, or by a Commonwealth, State or Territory authority, that identifies the person and their date of birth.
vii. If there is no one at the delivery address, or the person present is not of the required age (18 years of age), the goods will not be left at the premises. We will endeavour to contact you should no one be present.
viii. The person accepting delivery of goods may be required to provide photo identification, and when required, proof of age. If payment is made by credit card, we may also require verification.
ix. Goods will be delivered to the front door of the delivery address specified at the time of checkout on the date of delivery. Goods may be left unattended if no one is present at the address. If you request delivery beyond the front door and we agree, then you are liable for any damage or loss incurred while delivering your goods.
x. Happy at Home co will endeavour to meet preferred delivery times as
selected by you during checkout, however, this cannot be guaranteed. We will make all reasonable endeavours to ensure timely delivery. If your delivery is delayed, we will attempt to contact you with notification of this delay.
xi. We take special care to endeavour that deliveries are made within your chosen delivery slot and accordingly, it is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the delivery slot. If there is no one available to accept the delivery within the time slot Happy at Home Co will leave the delivery unattended at your address. Happy at Home Co expressly disclaims all liability that may arise by virtue of the delivery being left unattended for a period of time. This includes but is not limited to theft, tampering, contamination and the result of any change in temperature in respect of items that need to be kept chilled or frozen.
3. Cancellation or modification of an order
i. Happy at Home Co has the right to cancel or modify an order. An order will only be modified if you have accepted substitutions. If payment has been made for a delivery we cancel, the funds will be credited within 5 working days.
ii. You cannot cancel or modify an order after it has been submitted to us. Please contact the store to make any modifications or cancellations. For pick up or delivery orders, you may modify or cancel your order up to 48 hours before the pickup or delivery date. Any cancellation after this time may incur a $10 cancellation fee.
Modifications after this time cannot be made.
4. Payment Methods
i. Happy at Home Co uses the payment platform eWay to take payments from cutomers.
ii. Happy at Home Co is currently unable to accept payments from outside of Australia.
iii. Happy at Home Co are currently unable to accept payments from American Express.
iii. Happy at Home Co are currently unable to accept payments from American Express.
5. Fees and charges
i. Happy at Home Co will charge the following fees. You agree to pay these fees and any additional fees outlined in the Terms and Conditions. In addition, you agree to pay for the purchase of the goods.
ii. You will pay the delivery fee as outlined at the time of checkout.
iii. You will pay the service fee as outlined at the time of checkout.
iv. Any cancellation fee for an order cancelled outside of the cancellation window.
v. Any other fees and charges set out in these Terms and Conditions.
vi. All fees and charges specified and all prices quoted online include GST where applicable.
vii. As with shopping in our store, prices for our products change from
time to time and Happy at Home Co does not provide notice of these changes. Subject to these terms and Conditions, the price you order your goods at online is the price you will be charged. For items where a price has decreased in-store between the time your order is submitted and we finalise the order, you will be charged the checkout price.
viii. If a product you have ordered is unavailable Payment methods
i. You agree to make full payment for all purchased goods and any applicable fees or charges by one of the accepted payment methods. The accepted payment methods are Credit Card or Debit Card
ii. If we are unable to successfully process any payment for an order you have placed, we will first attempt to contact you in relation to the order to arrange alternative payment. If we are unable to contact you we can, at our complete discretion, cancel your order. You must not attempt to pay for any orders by unlawful or fraudulent means
iii. Happy at Home Co will email you a full receipt at the time of delivery or collection of your order, which specifies all fees and charges, prices for all items and any applicable discounts.
6. Product substitutions
i. You understand that from time to time, products may be temporarily unavailable. When this does happen, you will not be provided with that product.
ii. If you choose to accept substitutions, then any unavailable products will be substituted to the best of our ability.
iii. We will attempt to provide a substitute of similar quality and value to the product that is not available.
iv. Where a suitable substitution is not available we will not provide any product and you will not be refunded for the unavailable item.
v. Subject to the above points, we will endeavour to meet any specific requests you make in relation to substituted products but you acknowledge that we may not be able to accommodate these requests and that we are only bound to meet the conditions specified here.
vi. If a product is unavailable and you elect to receive substitutions, you agree to pay the substituted products’ current store price
7. Missing or damaged products
i. We provide a full receipt outlining products we have supplied via email. In the event that an item is missing, please first review your receipt to confirm if the item has been charged. If an item is unavailable and either you have elected not to receive substitutions or we were unable to substitute the missing item we will not have charged you. If we have charged you for an item that was not provided, please contact the store within 24 hours. If we determine that the product was not provided, we will arrange either a replacement or a refund.
ii. If you receive a damaged or faulty item, or are unsatisfied with the quality of any goods, please contact the store within 12 hours and we will, at our discretion, provide you a refund or replacement. You must provide the original receipt in order for us to be able to provide a refund or replacement.
